Bring on the Silly Season!

The Christmas and New Year period is fast upon us and everyone is starting to wind-down and get ready to leave for their favourite holiday spots!

Well almost everyone!

This time of year also brings a manic phase for landlords and tenants with many tenancies (particularly in student towns) concluding on December 31st and many more beginning on the 1st of January!

What is compounding the situation even further are all of the new regulations that have been introduced and speculated upon over the past 12 months. This includes the requirement for detailed insurance statements to be included in Tenancy Agreements, new insulation requirements and the introduction of the Healthy Homes Standards to name a few.

What are the changes that need to be considered right now?

  • Definition of Unlawful Premises;
  • Methamphetamine and Contaminant Standards.

  • Ensure that you have the most current version of the Tenancy Agreement Form (Available on the Tenancy Services website).

What to watch out for in the next 12 months…

Yet again, the government have proposed further changes to the Residential Tenancies Act. So just when landlords think they are getting ahead and on top of everything, more speculation and doubt is introduced.

Some of the changes proposed include removing ‘no cause’ 90 day terminations, changing fixed term tenancies to periodic tenancies upon expiry, changes to Tenancy Tribunal processes, increasing financial penalties, allowing tenants to add minor fittings/fixtures and bringing an end to the practice of rental bidding.

Now, not all of these changes are guaranteed to come into law as there may be changes along the way by legislators as they are only proposals at this stage. However landlords should keep an eye on any developments that could come through and subsequently have plans of how to deal with them swiftly.
